It is important to know upfront that hemp-derived CBD products and marijuana-derived products are two very distinct, different things. (Despite both being derived from cannabis plants.)
In most states the CBD-based products that you can safely and legally purchase are made from the hemp plant (Cannabis Sativa). Marijuana products, on the other hand, come from the Cannabis Indica plant.
Changes in the law, both at the federal level and state level, have helped to clarify the distinction between these two plants (and their derivative products) in the past decade.
Is CBD Oil legal in Wyoming?
Put simply, yes, CBD Oil and other CBD-based products are legal in Wyoming. This was made possible thanks to hemp and the federal passage of the 2018 Farm Bill (H.R.2 – Agriculture Improvement Act of 2018) which effectively legalized the cultivation and commercial distribution of the plant in all 50 states.
The passage of this legislation ensured that CBD Oil and CBD products are legal to consume in the state of Wyoming. However, there are still some wrinkles in the legal situation. For consumption by the general public, law requires that these CBD products only be derived from hemp plants, they cannot be derived from marijuana plants. Additionally, hemp-derived CBD products may only contain up to .3% THC (tetrahydrocannabinol) on a dry weight basis.
(THC is the psychoactive ingredient in marijuana that causes a person to achieve a “high” when it is consumed. Typically speaking, natural concentrations of THC in hemp plants are extremely low.)
If a CBD product meets the standards mentioned above, there is no requirement for prescription to obtain or consume these products. Consumers can purchase legally-produced CBD without a doctor’s recommendation within the state of Wyoming.
What are the current CBD laws in Wyoming?
As previously stated, CBD can be extracted from marijuana plants or hemp plants. Marijuana and marijuana-based products are still illegal in Wyoming, and the state keeps harsh laws on the books regarding this. The story is different for CBD products that are derived from hemp plants, these products are legal.
That said, for much of the 20th century, all forms of cannabis and cannabis-derived products were illegal in Wyoming.
Here is some history:
Sources on this subject appear to be uncertain when cannabis was outlawed in the state, but it happened early 20th century. It has been established that this restriction happened as early as 1913, though some sources point to 1929. Either way, by the 1930s, there was no legal grey area. By 1930, Cannabis was illegal in Wyoming in all instances, with no exceptions. Nothing changed on this front for the next one hundred years!
Finally, in 2015, after a century of total restriction, the situation began to shift. State representative Robert McKim [R] sponsored WY HB 32, seeking to legalize more medical treatment options for sufferers of seizures. The bill became law on July 1, 2015 and provided very narrow exceptions that allowed for the consumption of hemp-derived CBD oil… but only for residents suffering from intractable epilepsy.
Patients with this condition could join a registry and receive a hemp extract registration card that legally protected them to allow for medical consumption of CBD.
HB 32 did not provide a pathway for any in-state cultivation of CBD, whether hemp or marijuana based, nor did it provide a pathway for wide public consumption. But over the four years following the passage if this legislation, the campaign to legalize hemp-derived products took hold.
While the 2018 Farm Bill legalized hemp at the federal level across the United States, state laws have had to play catch up. There have been instances of state-level roadblocks in the wake of the 2018 Farm Bill’s passage. Fortunately, this is no longer the case in Wyoming and the legality of hemp-based CBD products has been further clarified in Wyoming statutes.
WY HB 171, spearheaded by state representative Carl “Bunky” Loucks [R] passed in March of 2019 with bipartisan support after Gov. Mark Gordon [R] signed it in to law. It officially removed hemp from the Wyoming Controlled Substances Act. This passage provided for hemp to be classified as an agricultural product so that “a person may produce or process hemp” so long as they had proper approval and licensing from the state.
