While marijuana plants typically have high concentrations of THC, hemp plants do not contain much THC at all.  Law only recognizes cannabis plants with THC concentrations of 0.3% or below as hemp; all other cannabis plants are classified as marijuana by federal law, making them controlled substances.

The distinctions that legally set hemp and marijuana apart come from provisions and definitions put forth in the 2018 federal Farm Bill. The passage of this bill helped to alleviate confusion about the two plants and marked the beginning of a new era for hemp. After passage of the bill, the legally permitted re-industrialization and commercialization of hemp began in earnest as states rushed to capitalize on economic potential.

Is CBD Oil legal in OK?

Yes, CBD is legal in Oklahoma. If the CBD is derived from the hemp plant, it is legal for use by members of the general public without a doctor’s note or license. The vast majority of CBD that one might see for sale in convenience or retail environments falls under this category.

CBD that is derived from marijuana can be accessed by medicinal patients, but only if they are in possession of a state-issued permit. The circumstances required to meet these exceptions are narrow.

What are the current CBD laws in OK?

Movements to reverse the harsh legal barriers to cannabis use have been growing in recent decades.

The legalization of hemp CBD is part of a larger story involving cannabis prohibition and the movement to repeal that prohibition for both medicinal and recreational users.

The federal Farm Bills of both 2014 and 2018 did much to create a pathway for the re-legalization of hemp by removing it from the legal definition of marijuana and establishing it as an industrial crop.

This is a movement that has evolved (and continues to evolve) at federal, state, and local levels. As a result, the framework for legal cannabis, and the punishments for illegal cannabis, vary greatly from state to state, and even city to city.

This is as true in the Sooner State as it is throughout the rest of the United States.

While all forms of cannabis were highly restricted and tightly controlled for much of the 20th century, due in part to the Controlled Substances Act (CSA) of 1970, restrictions appeared much earlier in Oklahoma. Cannabis was first banned in OK in 1933.

Little changed on this front for the remainder of the last century, but things began to change in the 2010s.

One of the first major actions to reverse cannabis prohibition happened in 2015 when Governor Mary Fallin signed HB 2154, also known as “Katie and Cayman’s Law.” This bill authorized a pilot program to allow low-THC CBD to be administered by medical professionals for treatment of intractable epilepsy.

CBD derived from hemp, rather than marijuana, began to appear for sale in retail environments around this time.

Today Oklahoma law has found alignment with federal laws put forth for hemp in 2018. Hemp CBD is readily available to the general public.

Worth noting: referendum SQ788, promoted in part by an organization known as Green the Vote, put medical legalization on the ballot in 2018. The vote finally took place after several years of legal back-and-forth over the verbiage of the measure.

The referendum ultimately passed by direct vote of the citizenry with 57% of voters supporting the medical use of cannabis.
