First things first: most of the legal CBD for sale in the United States does NOT come from marijuana, and in most states, you do not need a medical card to obtain it.

CBD is not a plant, but a plant extract. That extract can be derived from hemp or marijuana. Hemp is another cannabis plant very closely related to marijuana, but they are not considered to be the same plant in the eyes of federal law.

There is one defining difference between hemp and marijuana: hemp and its extracts do not contain high concentrations of the tetrahydrocannabinol (THC) compound. THC is one of more than 100 cannabinoids (compounds found within cannabis extracts)—and it is the psychoactive compound famous for causing users to experience a “high” when consumed.

Because hemp extracts do not contain high amounts of THC within their chemical makeup, these extracts, including hemp CBD, cannot intoxicate users.

Is CBD Oil legal in North Dakota?

Every state in the U.S. is empowered to create their own legal framework when it comes to cannabis, industrial hemp, and CBD. The legality of CBD hinges on which plant the CBD is sourced from, and what a state’s legal framework looks like.

Hemp CBD Oil is legal in North Dakota, according to statements released by North Dakota law enforcement.

Users who wish to consume medical grade CBD, like CBD derived from marijuana, must go through complicated channels and the state’s medical cannabis program.

As for hemp CBD: even though hemp and thus, hemp-based CBD were legalized at the federal level in 2018, states must also grant permission and may set up their own regulatory system. Though some questions remain, North Dakota has taken steps to bring their laws in to alignment with federal law when it comes to hemp and hemp CBD.

A statement made by the Fargo Police Department and Cass County State Attorney’s office, released in mid-2019, appears to confirm legality of hemp CBD within the state.

What are the current CBD laws in North Dakota?

To track where laws about CBD currently stand in North Dakota, it is useful to look back at how the laws surrounding cannabis unfolded over the course of the last century. Cannabis was classified as a Schedule I substance by the federal government after the institution of the Controlled Substances Act (CSA) in 1970.

But it was outlawed in North Dakota much earlier, in 1933.

Over the course of many decades after the CSA, activists and grassroots movements campaigned to institute cannabis reform on several fronts.

Medical cannabis was approved in the state in 2016 via Measure 5, which established a medical cannabis program within the state.

With the passage of the 2014 and 2018 federal Farm Bills, hemp was legalized at the federal level—but there is still an issue of state legality.

Incentivized by the potential of a new, legally permitted crop, most states have followed in the footsteps of the federal government to fully legalize hemp for sale and consumption to and by the general public.

North Dakota has made some progress on this front.

A bill passed in 2019, HB 1349 (introduced by Rep. Monson, D. Johnson, Kading; Sen. Luick, Oban, Wanzek) moved to officially legalize hemp production in North Dakota and set up a regulatory system for licensing.

Shortly after HB 1349, another bill, HB 113 updated the definition of marijuana to exclude hemp.

Some have asserted that questions remain on whether individual hemp CBD products must obtain explicit FDA approval to be sold in North Dakota. Regardless of this legal wrinkle, it is not uncommon to find CBD products for sale in general retail environments.
